Judicial Panel Agrees to Reconsider Legal Matter

The federal appeals court decided on this week that it would reexamine the legal dispute concerning the executive power with an expanded group of eleven justices. The court also vacated a previous ruling from a three-judge panel that had sided with the administration.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a protracted court case over whether the former president has the legal right and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in response to months of protests.

Differing Viewpoints

The administration has argued that federal officials at the ICE facility in south Portland were facing threats, while local authorities assert that local officers have command of the situation.

In defiance of descriptions of Portland as “war ravaged”, residents have been sharing videos of scenic paths and a thriving food scene, and organizing events such as an protest bicycle event against the increased military presence.

Court Proceedings

The Tuesday ruling came after a federal judge in the city enacted two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any national guard troops in the state, after attempts to evade the initial injunction by calling up troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting control of 200 Oregon national guard – but the second ruling remained in place, blocking the physical sending of the troops.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with all decisions under review together – by a group of 11 judges.

“This decision shows that the truth matters and that the judicial system are working to hold this administration accountable. The constitution limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the military into US cities unnecessarily. We will continue protecting state legislation, principles, and autonomy as this legal proceeding moves forward and our legal battle continues in the judicial system.”
